Unfortunately, when a person is attacked by a dog the result can be devastating to the victim. Many times owners of dangerous dogs are negligent and let their dogs out of their cages or pens causing serious injuries to people who happen to be at the wrong place at the wrong time. Even more tragic is that the victims of these brutal attacks are often small children. Owners of dangerous dogs have been known to not put dangerous dogs in a place they cannot get out when small children are in the area or in their home.

Two recent examples of successful outcomes of dog bite cases are when a client took his girlfriends dog to the kennel for grooming and the employee took our client for a tour of the facility and he was attacked by a dog. We obtained a settlement for this client in the amount of 125,000 (one hundred twenty five thousand. We also recently helped a client that was attacked by a neighbor's dog on two separate occasions. On the first the client was over at the neighbors and their dog bit our client and we recovered 30,000.00 (thirty thousand) and the same client was bitten a second time by the same dog when the neighbors recklessly let the dog out knowing of its violent nature. The second attack we obtained a settlement of $125,000.00 for our client.

The law is such in Missouri that a victim of a dog bite cannot automatically collect for their injuries on a dog bite case. The law states that unless a dog is of a vicious breed ie Pit Bulls or German Shepherds the dog must have bitten before for you to collect on a dog bite case. In other words the dog is allowed one "free bite" before you can sue an owner for an attack. This is because the law believes that as they say a dog is "man's best friend" and you are not allowed to sue unless the owner was aware of a previous attack by their dog. If however the dog was such that it was part of a vicious breed and the owner did not take precautions to prevent an attack than it would be easier to bring a claim against the owner of the dog. Many times a owners homeowners insurance will pay a claim on the dog owners behalf. Therefore it may be difficult to bring a claim against a person who rents and does not have renters insurance. On the cases we have handled we have done extensive investigation to determine various aspects of the case including whether a dog has displayed vicious tendencies.

Many people often wonder how much they will get for their case. Unfortunately, this is not always easily attainable at the beginning of a case. The reason is that you never want to settle a case before you are aware of what all the medical bills will be and of course you will not know this at the beginning of a case. The value of a case also involves whether injuries are of a temporary nature or will be permanent. Also, a claim must take into account whether there was any lost wages. In other words, did the client lose time from work and if so how much. Sometimes lost wages will be a very considerable amount of a claim depending on how many weeks someone was off work. On more serious claims there are times when a person becomes permanently disabled and the amount recovered for a client much take this into account.
